Introduction 

The privacy and protection of Personal Information is important to us. Personal Information We Collect and How We Collect It 

“Personal Information” means any information relating to an identified or identifiable natural person (“Data Subject”). An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, mental, economic, cultural or social identity of that natural person. 

Par Health collects information when you use our Services in the following ways: 

When You Submit Information to Par Health: 

We collect and maintain Personal Information about you to understand and meet your needs, provide our Services, manage our business, and for other purposes disclosed to you at the point of collection. We collect and store information you enter, provide to us in written form, or communicate to us verbally. This may include: 

 

  • Personal identifiers such as your name, address, email address, account name and password, professional license number; 

  • If you apply for employment, we may collect Personal Information necessary to process your application. This may include, among other things, your telephone number, postal address, email address, age, location, benefits elections, employment history, salary information, educational background, driver’s license or social security number. 

  • Business contact information (e.g., information printed on a business card); 

  • Professional, educational, or employment-related information about healthcare professionals: name of your practice, academic background, professional designation, medical specialty, licensing and disbarment status, publications and information about public speeches, and additional personal data you provide in your curriculum vitae or other similar documents or communications;  

  • Personal or physical characteristics protected under federal or state law, such as gender, race, ethnicity, age, disability, AIDS/HIV status; 

  • Commercial information, including products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies; 

  • Internet or other electronic network activity information, including, but not limited to, browsing history, search history, and information regarding a consumer’s interaction with an internet website, application, or advertisement; 

  • Geolocation data (not precise); 

  • Financial information, including bank account information; 

  • Health-related data, including information provided in connection with reported adverse reactions to our pharmaceuticals; 

  • Audio, electronic, visual, or similar information, including voice recordings; 

  • Inferences drawn from any of the information to create a profile about individuals reflecting preferences, characteristics, psychological trends, preferences, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes; or 

  • Certain categories of your Personal Information are regarded as “sensitive” or “special”, depending on the applicable law. In addition to the Sensitive Personal Information included above, the following additional sensitive Personal Information may be collected but only with your consent: religious, social security number, philosophical, political beliefs, trade union membership, ethnic or racial origin, biometric data used for the purpose of uniquely identifying a person, genetic data, or sex life and/or sexual orientation.  

 

We only process such sensitive Personal Information where it is necessary for the establishment, exercise, or defense of legal claims, where it is necessary for reasons of public interest in the area of public health (such as ensuring high standards of quality and safety of medicinal products), or where we have obtained your explicit consent to process such data or where we are required or allowed to do so under applicable law. Where processing is based on your consent, you have the right to withdraw that consent at any time. 

Through Automated Means:  

When You Use the Services: We collect information about how you use the Services: 

  • Through Server Logs: A server log is a list of the activities that a server performs. Par Health’s servers automatically collect and store in server logs your search queries, Internet Protocol (IP) address, hardware settings, browser type, browser language, the date and time of your request and referral URL, and certain cookies that identify your browser or Par Health account. 

  • From Your Computer or Mobile Device: We collect device-specific information, such as your computer or mobile phone model, operating system version, device identifiers, and mobile network information. 

From Third Parties: 

Par Health collects information from non-affiliated parties who you direct or authorize to share information with us, such as affiliated organizations, our research partners, collaborators, and service providers. We also sometimes collect information from publicly accessible sources such as government records, websites, social media, and other digital platforms.

Purpose And Legal Basis for Processing 

We may process Personal Information provided by you in accordance with the following legal bases under the European Union and United Kingdom General Data Protection Regulation:  

  • Where processing Personal Information is necessary for our legitimate business interest in managing our business including legal, personnel, administrative, customer service, and management purposes and for complying with our reporting obligations to regulators including in relation to complaints or adverse events experienced in relation to our products, provided our business interests are not overridden by your interest. Please note that you have a right to object to processing of your Personal Information where that processing is carried on for our legitimate interest. 

  • Where processing Personal Information is necessary in order for us to comply with legal or regulatory obligations. 

  • Where processing Personal Information is necessary for the performance of a contract with you. 

  • Where Personal Information is necessary in order to protect your vital interests or the vital interests of a third party. 

  • After obtaining your consent to use your Personal Information for a specific purpose. Where processing is carried out based on your consent, you will have the right to withdraw your consent to such processing at any time. 

Uses of Personal Information 

We may use the information we collect from or about you to: 

  • Provide the Services, including to personalize the Services and process any transactions you request;  

  • Improve the Services, including research and analytics regarding use of the Services; 

  • Communicate with you to fulfill your requests and respond to your comments and inquiries; 

  • Authenticate your identity; 

  • Deliver advertising, including interest-based advertising on our websites and on other websites and applications; 

  • Process job applications and carry out the recruitment process, including background checks (where applicable), drug screenings (where applicable), verifying your information, and/or conducting research about your educational and professional background; 

  • Communicate with shareholders on matters relating to regulatory filings, governance guidelines, sustainability, and similar topics; 

  • Support our clinical trials and research activities; 

  • Investigate and report adverse events to regulators;  

  • Manage our vendors, including due diligence, contract signing, compliance to regulations, screening, auditing, on-going monitoring etc.; 

  • Facilitate registration at events we sponsor; 

  • Provide scientific information about our research and products;  

  • Administer advisory boards and other committees that we convene; 

  • Detect, investigate, and prevent activities that may violate our policies or be fraudulent or illegal; or 

  • Comply with our legal, regulatory, operational, and fiscal obligations.   

We may combine information that you provide to us or information that we collect automatically through our Services with other information we obtain from our business records, including your use of Par Health products, services, websites and applications and, where applicable, your preferences and other personal characteristics. We also may use or combine information that we collect with information we obtain from non-affiliated parties, including demographic information and other attributes, such as census data, demonstrated interests, and organizational affiliations. Additionally, information collected from a particular browser or device may be used with another computer or device that is linked to the browser or device on which such information was collected. 

We may use information we collect from or about you to create aggregated or de-identified data that does not identify you. Once the data is aggregated or de-identified, we may use it for any purpose permitted by law and we may disclose it to non-affiliated parties for their own uses. To the extent we deidentify any data originally based on Personal Information, we will maintain and use such data in deidentified form and will not attempt to reidentify the data.

Disclosures of Personal Information 

We may disclose Personal Information in close relation to the purposes specified above to trusted third parties, collectively referred to as “Recipients.” 

  • Affiliates and Acquisitions. We may share your Personal Information with our corporate affiliates (i.e., parent company, sister companies, subsidiaries, joint ventures, or other companies under common control).  If another company acquires our company, one of our businesses, or our assets, we will also share your Personal Information with that company as necessary, including at the negotiation stage. 

  • Other Disclosures with Your Consent.  We may ask if you would like us to share your information with other unaffiliated third parties who are not described elsewhere in this Policy. 

  • Other Disclosures of Personal Information if Required by Law or to Protect our Rights. We will disclose Personal Information when required in response to subpoenas, warrants, or court orders, in connection with any legal or regulatory process, or to comply with relevant laws.  We will also share your Personal Information as necessary in order to establish or exercise our rights, to defend against a legal claim, to investigate, prevent, or take action regarding possible illegal activities, suspected fraud, safety of person or property, for audit purposes, or a violation of our policies. 

  • Service Providers. We may share your Personal Information with service providers that are committed to/or under appropriate statutory obligations of confidentiality such as website hosting; email services; marketing; clinical research organizations (CROs); clinical trial administration, advertising, auditing; payment processing; fulfilling customer orders; data analytics; providing customer support; conducting customer research and satisfaction surveys; managing events; accepting grant applications;  cloud storage services; and other services that assist in providing or selling our products and services. These service providers may collect, store, analyze, or otherwise process information on our behalf. 

How We Protect Personal Information 

No method of transmission over the internet, or method of electronic storage, is fully secure. While Par Health implements appropriate technical and organizational security measures to protect your Personal Information from unauthorized access, use, or disclosure, due to the public nature of the internet, we cannot guarantee the security of your Personal Information. In the event that we are required by law to inform you of any unauthorized access to your Personal Information, we will notify you electronically, in writing, or by telephone, if permitted to do so by law.

Retention 

We will only retain your Personal Information for as long as necessary to fulfill the purposes for which it was collected by us, including for the purposes of complying with our data retention policies and procedures and satisfying any legal, accounting, or reporting requirements, including applicable statute of limitations periods.

Cookies and Other Web Devices 

Like many websites, we use digital tracking technologies such as cookies, pixels, web beacons, and similar technologies (collectively, “Cookies”) to record your preferences, track the use of our Sites, and for the related purposes described below. We may also use these technologies to monitor traffic, improve the Sites, and make the Sites easier to use and more relevant.

Analytics/ Performance Cookies 

Analytics Cookies provide us with information regarding how visitors navigate and interact with our Sites.  Such Cookies allow us to understand, for example, more about how many visitors we have to our Sites, how many times they visit us, and how many times a user viewed specific pages within our Sites.  Among other Analytics Cookies, we use Google Analytics Cookies for these purposes. Advertising/ Targeting Cookies 

Advertising Cookies may be placed by us or third parties to enable third party ad networks to recognize a unique Cookie on your computer or mobile device.  The information that is collected and shared by these types of Cookies may also be linked to the device identifier of the device you are using to allow us to keep track of all the websites you have visited that are associated with the ad network. This information may be used for the purpose of targeting advertisements on our Sites and third-party sites based on those interests.  

Commercially Recognized Opt-Out Signal (Global Privacy Controls, Do Not Track) 

Par Health generally recognizes certain commercially recognized opt-out preference signals (e.g., Global Privacy Controls). Recognition of this signal applies only to the specific device and/or browser that communicates the signal and does not apply to other devices/browsers you use to access our Services. 

Your Cookie Choices 

Each website can send its own cookie to your web browser if your browser's preferences allow it. Cookie settings can be controlled in your internet browser to automatically reject some forms of cookies. If you do not allow cookies, some features and functionality of our Sites may not operate as expected. 

Par Health may use Adobe Flash technology (including Flash Local Stored Objects "Flash LSOs") that allow Par Health to, among other things, serve you with more tailored information, facilitate your ongoing access to and use of the Site, and collect and store information about your use of the Site. Some of our Sites or emails also use pixel tags, web beacons, clear GIFs, or other similar technologies to measure the success of marketing campaigns, and compile statistics about usage and response rates, and other purposes. 

You may change your cookie preferences by clicking on the cookies icon at the bottom of our Site. 

Par Health may use other web devices to track website usage and views.  

Your Privacy Rights 

Depending on where you are located (e.g., California, the European Union, the United Kingdom), you may have certain rights regarding your Personal Information:  

Your Right to Know and Right of Data Portability 

You have the right to request that we provide certain information to you about our collection and use of your Personal Information. You also have the right to request that we provide the specific pieces of Personal Information we collected about you in a machine-readable format. 

Your Right to Delete 

You have the right to request that we delete Personal Information collected from you subject to certain exceptions.  

Your Right to Correct 

If we receive a verifiable request from you to correct inaccurate Personal Information about you, we will use commercially reasonable efforts to correct such Personal Information. 

Your Right to Restrict Processing 

You have the right to request that we restrict the processing of your Personal Information, under certain conditions. In such case and if the right applies, the respective Personal Information will be marked and may only be processed by us for certain purposes. 

Right to Object to Processing 

You have the right to object to our processing of your Personal Information, under certain conditions, and we can be required to no longer process your Personal Information. Such right to object may especially apply if we collect and process your Personal Information through automated decision making, such as profiling, to better understand your interests in our products and Services or for direct marketing, which we do not do at the current time.  If you have a right to object and you exercise this right, your Personal Information will no longer be processed by us for such purposes. Such a right to object may not exist if the processing of your Personal Information is necessary to take steps prior to entering into a contract or to perform a contract already concluded.  

Right to Withdraw Consent 

Where we rely on your consent to process your Personal Information, you have the right to withdraw that consent at any time with future effect. Such a withdrawal will not affect the lawfulness of the processing prior to the consent withdrawal.  

Right to Opt-Out of the Sale or Sharing of Personal Information 

We do not and have not in the preceding 12 months, sold or shared your Personal Information (disclosed your Personal Information with a third party in exchange for monetary compensation and/or other valuable consideration). With your consent, we do use and disclose your Personal Information for cross-contextual behavioral advertising. You can revoke your consent by clicking on the “Cookie Setting” button at the footer of our webpage.   

You Can Opt-Out of Receiving Our Marketing Emails 

When you sign up for our newsletter, you will be asked to provide us with an accurate e-mail address through which we may contact you. Such registration constitutes your express acknowledgment that we may use your e-mail address to communicate with you about product offerings (unless affirmative consent is otherwise required by applicable law). To stop receiving our promotional emails, you may email us at privacy@parhealth.com or follow the instructions in any promotional message you get from us. Even if you opt out of getting marketing messages, we may still contact you through email in response to your questions.

Non-Discrimination. 

You have the right to not be discriminated against because you exercise any of your rights described above. However, you may not be able to participate in some of our Services depending on the rights you exercise.  

Exercising Your Rights.  

Please note that many of the above rights are subject to exceptions and limitations, and our responses will vary based on the circumstances of the request and on your location. If you choose to assert any of these rights under applicable law, we will respond in accordance with and within the time-period prescribed by such law. 

If you are located in the State of California in the United States, a person authorized to act on your behalf may make a verifiable request related to your Personal Information.  If you designate an authorized person to submit requests to exercise certain privacy rights on your behalf, we will require verification that you provided the authorized agent permission to make a request on your behalf.  

When you submit a request, your request must: (i) provide sufficient information that allows us to reasonably verify that you are the person about whom we collected Personal Information or an authorized representative of that person; and (ii) describe the request with sufficient detail that allows us to properly understand, evaluate, and respond to it. We will only use Personal Information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.  

To exercise your rights, you must provide us with a copy of the signed permission you have given to the authorized agent to submit the request on your behalf and verify your own identity directly with us.  If you are an authorized agent submitting a request on behalf of an individual you must attach a copy of the following information to the request: 

  1. A completed Authorized Agent Designation Form indicating that you have authorization to act on the consumer’s behalf. 

  1. If you are a business, proof that you are registered with the Secretary of State to conduct business in California. 

If we do not receive both pieces of information, the request will be denied.

You may have the right to lodge a complaint with the applicable regulatory authority if you are not satisfied with how your Personal Information is being handled.  

Transfer Of Personal Information Outside the European Economic Area (EEA) and United Kingdom (UK) 

Due to the global nature of our business, the Personal Information that we collect from you may be transferred to, and stored at, a destination outside the jurisdiction where you are located for the purposes described above. It may also be processed by personnel operating outside the EEA/UK who work for us or for one of our suppliers who act on our behalf. Those countries may not provide an adequate level of protection in relation to processing your Personal Information. We will ensure appropriate safeguards are in place to protect the privacy and integrity of Personal Information transferred outside of the EEA/UK (e.g., by making use of standard contractual clauses). You can obtain information concerning such safeguards by emailing us at  privacy@parhealth.com, where applicable.

Other Important Information 

The following additional information relates to our privacy practices: 

  • Minors. Our Sites are not for individuals under age 18. Those individuals should not access our Sites or provide Personal Information to us. 

  • Third-Party Applications/Websites.  We have no control over the privacy practices of websites or applications that we do not own. Please reference their applicable privacy policies.  

  • Changes to This Policy.  We may change our Policy and practices over time.  To the extent that our Policy changes in a material way, the version of the Policy that was in place at the time that you submitted Personal Information to us will generally govern that information.  Our Policy includes an “effective date” and a “last updated” date. The “effective date” refers to the date that the current version took effect. The “last updated” date refers to the date that the current version was last substantively modified.

This Consumer Health Data Privacy Policy applies to “Consumer Health Data,” as that term has been defined under applicable law. Any term appearing in this Consumer Health Data Privacy Policy that has been defined under applicable Consumer Health Data laws shall have the meaning afforded to it therein. 

A. Our Collection of Consumer Health Data 

We may collect the following categories of Consumer Health Data from Consumers: 

  • Individual health conditions, treatment, diseases, or diagnosis;  

  • Social, psychological, behavioral, and medical interventions;  

  • Health-related surgeries or procedures;  

  • Use or purchase of prescribed medication;  

  • Bodily functions, vital signs, symptoms, or measurements related to health;  

  • Diagnoses or diagnostic testing, treatment, or medication;  

  • Reproductive or sexual health information;  

  • Precise location information that could reasonably indicate a Consumer's attempt to acquire or receive health services or supplies;  

  • Data that identifies a Consumer seeking health care services; and 

  • Health-related data that have been derived or inferred from the above.  

We may collect and use the above-mentioned categories of Consumer Health Data for the following purposes: 

  • To perform the services or provide the goods reasonably expected by an average Consumer who requests those goods or services; 

  • To prevent, detect, and investigate security incidents that compromise the availability, authenticity, integrity, or confidentiality of stored or transmitted Personal Data; 

  • To resist malicious, deceptive, fraudulent, or illegal actions directed at Par Health and to prosecute those responsible for such actions; 

  • To ensure the physical safety of natural persons; 

  • For short-term, transient use, including, but not limited to, nonpersonalized advertising shown as part of a Consumer’s current interaction with Par Health, provided that the personal information is not disclosed to another third party and is not used to build a profile about the Consumer or otherwise alter the Consumer’s experience outside the current interaction with us; 

  • To perform services on behalf of our business, such as maintaining or servicing accounts, providing customer service, processing or fulfilling orders and transactions, verifying customer information, processing payments, providing financing, providing analytic services, providing storage, or providing similar services on behalf of our business; 

  • To verify or maintain the quality or safety of a product, service, or device that is owned, manufactured, controlled by, or manufactured for Par Health, and to improve, upgrade, or enhance the service or device that is owned, manufactured by, manufactured for, or controlled by us;  

  • To collect or process Sensitive Personal Data where the collection or processing is not for the purpose of inferring characteristics about a consumer; and 

  • Targeted advertising.

We Collect Consumer Health Data directly from Consumers and from the following sources:  

  • Vendors and third parties when they disclose Consumer Health Data to Par Health; and 

  • Through Automated means when you utilize the services.

We may Share all of the categories of Consumer Health Data that we collect. 

D. Third Parties and Affiliates with Whom We Share Consumer Health Data 

We may Share Consumer Health Data with the following Third Parties:

  • With your consent or at your direction; 

  • In connection with a sale, reorganization, joint venture, or other similar business transaction; and

Supplement to Consumer Health Data Privacy Policy for Nevada Consumers 

This Supplement applies to Nevada Consumers for purposes of providing additional disclosures required by Nevada’s Consumer Health Data privacy law. Terms used herein that are defined terms under Nevada’s Consumer Health Data privacy law shall have the meanings afforded to them therein. 

A. Purposes & Manner of Processing. We Collect, Use, Process, and Share Consumer Health Data for the purposes and in the manners described in our Privacy Notice for Consumers, customers, and other business contacts which also provides additional disclosures relevant to Nevada consumers. 

B. Review & Revision of Consumer Health Data. If you would like to review and/or revise your Consumer Health Data, you may submit a request to Par Health via the methods listed in our Consumer Health Data Privacy Policy. We will respond to your requests to exercise your rights in accordance with applicable law.  

C. Changes to this Supplement. We will notify you before making any changes to our privacy practices with respect to your Consumer Health Data by posting an updated notice on this page, with an updated effective date. 

D. Third Party Collection of Consumer Health Data. Please note that some third parties may collect Consumer Health Data about you over time and across different websites or online services you may visit.

  • Inferences drawn from any of the information to create a profile about individuals reflecting preferences, characteristics, psychological trends, preferences, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes; or 

  • Certain categories of your Personal Information are regarded as “sensitive” or “special”, depending on the applicable law. We only process such sensitive Personal Information where it is necessary for the establishment, exercise, or defense of legal claims, where it is necessary for reasons of public interest in the area of public health (such as ensuring high standards of quality and safety of medicinal products), or where we have obtained your explicit consent to process such data or where we are required or allowed to do so under applicable law. Where processing is based on your consent, you have the right to withdraw that consent at any time. 

Through Automated Means:  

When You Use the Services: We collect information about how you use the Services: 

  • Through Server Logs: A server log is a list of the activities that a server performs. Par Health’s servers automatically collect and store in server logs your search queries, Internet Protocol (IP) address, hardware settings, browser type, browser language, the date and time of your request and referral URL, and certain cookies that identify your browser or Par Health account. 

  • From Your Computer or Mobile Device: We collect device-specific information, such as your computer or mobile phone model, operating system version, device identifiers, and mobile network information. 

From Third Parties: 

Par Health collects information from non-affiliated parties who you direct or authorize to share information with us, such as affiliated organizations, our research partners, collaborators, and service providers. We also sometimes collect information from publicly accessible sources such as government records, websites, social media, and other digital platforms.

Purpose And Legal Basis for Processing 

We may process Personal Information provided by you in accordance with the following legal bases under the European Union and United Kingdom General Data Protection Regulation:  

  • Where processing Personal Information is necessary for our legitimate business interest in managing our business including legal, personnel, administrative, customer service, and management purposes and for complying with our reporting obligations to regulators including in relation to complaints or adverse events experienced in relation to our products, provided our business interests are not overridden by your interest. Please note that you have a right to object to processing of your Personal Information where that processing is carried on for our legitimate interest. 

  • Where processing Personal Information is necessary in order for us to comply with legal or regulatory obligations. 

  • Where processing Personal Information is necessary for the performance of a contract with you. 

  • Where Personal Information is necessary in order to protect your vital interests or the vital interests of a third party. 

  • After obtaining your consent to use your Personal Information for a specific purpose. Where processing is carried out based on your consent, you will have the right to withdraw your consent to such processing at any time. 

Uses of Personal Information 

We may use the information we collect from or about you to: 

  • Provide the Services, including to personalize the Services and process any transactions you request;  

  • Improve the Services, including research and analytics regarding use of the Services; 

  • Communicate with you to fulfill your requests and respond to your comments and inquiries; 

  • Authenticate your identity; 

  • Deliver advertising, including interest-based advertising on our websites and on other websites and applications; 

  • Process job applications and carry out the recruitment process, including background checks (where applicable), drug screenings (where applicable), verifying your information, and/or conducting research about your educational and professional background; 

  • Communicate with shareholders on matters relating to regulatory filings, governance guidelines, sustainability, and similar topics; 

  • Support our clinical trials and research activities; 

  • Investigate and report adverse events to regulators;  

  • Manage our vendors, including due diligence, contract signing, compliance to regulations, screening, auditing, on-going monitoring etc.; 

  • Facilitate registration at events we sponsor; 

  • Provide scientific information about our research and products;  

  • Administer advisory boards and other committees that we convene; 

  • Detect, investigate, and prevent activities that may violate our policies or be fraudulent or illegal; or 

  • Comply with our legal, regulatory, operational, and fiscal obligations.   

We may combine information that you provide to us or information that we collect automatically through our Services with other information we obtain from our business records, including your use of Par Health products, services, websites and applications and, where applicable, your preferences and other personal characteristics. We also may use or combine information that we collect with information we obtain from non-affiliated parties, including demographic information and other attributes, such as census data, demonstrated interests, and organizational affiliations. Additionally, information collected from a particular browser or device may be used with another computer or device that is linked to the browser or device on which such information was collected. 

We may use information we collect from or about you to create aggregated or de-identified data that does not identify you. Once the data is aggregated or de-identified, we may use it for any purpose permitted by law and we may disclose it to non-affiliated parties for their own uses. To the extent we deidentify any data originally based on Personal Information, we will maintain and use such data in deidentified form and will not attempt to reidentify the data.

Disclosures of Personal Information 

We may disclose Personal Information in close relation to the purposes specified above to trusted third parties, collectively referred to as “Recipients.” 

  • Affiliates and Acquisitions. We may share your Personal Information with our corporate affiliates (i.e., parent company, sister companies, subsidiaries, joint ventures, or other companies under common control).  If another company acquires our company, one of our businesses, or our assets, we will also share your Personal Information with that company as necessary, including at the negotiation stage. 

  • Other Disclosures with Your Consent.  We may ask if you would like us to share your information with other unaffiliated third parties who are not described elsewhere in this Policy. 

  • Other Disclosures of Personal Information if Required by Law or to Protect our Rights. We will disclose Personal Information when required in response to subpoenas, warrants, or court orders, in connection with any legal or regulatory process, or to comply with relevant laws.  We will also share your Personal Information as necessary in order to establish or exercise our rights, to defend against a legal claim, to investigate, prevent, or take action regarding possible illegal activities, suspected fraud, safety of person or property, for audit purposes, or a violation of our policies. 

  • Service Providers. We may share your Personal Information with service providers that are committed to/or under appropriate statutory obligations of confidentiality such as website hosting; email services; marketing; clinical research organizations (CROs); clinical trial administration, advertising, auditing; payment processing; fulfilling customer orders; data analytics; providing customer support; conducting customer research and satisfaction surveys; managing events; accepting grant applications;  cloud storage services; and other services that assist in providing or selling our products and services. These service providers may collect, store, analyze, or otherwise process information on our behalf. 

How We Protect Personal Information 

No method of transmission over the internet, or method of electronic storage, is fully secure. While Par Health implements appropriate technical and organizational security measures to protect your Personal Information from unauthorized access, use, or disclosure, due to the public nature of the internet, we cannot guarantee the security of your Personal Information. In the event that we are required by law to inform you of any unauthorized access to your Personal Information, we will notify you electronically, in writing, or by telephone, if permitted to do so by law.

Retention 

We will only retain your Personal Information for as long as necessary to fulfill the purposes for which it was collected by us, including for the purposes of complying with our data retention policies and procedures and satisfying any legal, accounting, or reporting requirements, including applicable statute of limitations periods.

Like many websites, we use digital tracking technologies such as cookies, pixels, web beacons, and similar technologies (collectively, “Cookies”) to record your preferences, track the use of our Sites, and for the related purposes described below. We may also use these technologies to monitor traffic, improve the Sites, and make the Sites easier to use and more relevant.

This information may be used for the purpose of targeting advertisements on our Sites and third-party sites based on those interests.  

Commercially Recognized Opt-Out Signal (Global Privacy Controls, Do Not Track) 

Par Health generally recognizes certain commercially recognized opt-out preference signals (e.g., Global Privacy Controls). Recognition of this signal applies only to the specific device and/or browser that communicates the signal and does not apply to other devices/browsers you use to access our Services. 

Your Cookie Choices 

Each website can send its own cookie to your web browser if your browser's preferences allow it. Cookie settings can be controlled in your internet browser to automatically reject some forms of cookies. If you do not allow cookies, some features and functionality of our Sites may not operate as expected. 

Par Health may use Adobe Flash technology (including Flash Local Stored Objects "Flash LSOs") that allow Par Health to, among other things, serve you with more tailored information, facilitate your ongoing access to and use of the Site, and collect and store information about your use of the Site. Some of our Sites or emails also use pixel tags, web beacons, clear GIFs, or other similar technologies to measure the success of marketing campaigns, and compile statistics about usage and response rates, and other purposes.

Your Privacy Rights 

Depending on where you are located (e.g., California, the European Union, the United Kingdom), you may have certain rights regarding your Personal Information:  

Your Right to Know and Right of Data Portability 

You have the right to request that we provide certain information to you about our collection and use of your Personal Information. You also have the right to request that we provide the specific pieces of Personal Information we collected about you in a machine-readable format. 

Your Right to Delete 

You have the right to request that we delete Personal Information collected from you subject to certain exceptions.  

Your Right to Correct 

If we receive a verifiable request from you to correct inaccurate Personal Information about you, we will use commercially reasonable efforts to correct such Personal Information. 

Your Right to Restrict Processing 

You have the right to request that we restrict the processing of your Personal Information, under certain conditions. In such case and if the right applies, the respective Personal Information will be marked and may only be processed by us for certain purposes. 

Right to Object to Processing 

You have the right to object to our processing of your Personal Information, under certain conditions, and we can be required to no longer process your Personal Information. Such right to object may especially apply if we collect and process your Personal Information through automated decision making, such as profiling, to better understand your interests in our products and Services or for direct marketing, which we do not do at the current time.  If you have a right to object and you exercise this right, your Personal Information will no longer be processed by us for such purposes. Such a right to object may not exist if the processing of your Personal Information is necessary to take steps prior to entering into a contract or to perform a contract already concluded.  

Right to Withdraw Consent 

Where we rely on your consent to process your Personal Information, you have the right to withdraw that consent at any time with future effect. Such a withdrawal will not affect the lawfulness of the processing prior to the consent withdrawal.  

Right to Opt-Out of the Sale or Sharing of Personal Information 

We do not and have not in the preceding 12 months, sold or shared your Personal Information (disclosed your Personal Information with a third party in exchange for monetary compensation and/or other valuable consideration). With your consent, we do use and disclose your Personal Information for cross-contextual behavioral advertising. You can revoke your consent by clicking on the “Cookie Setting” button at the footer of our webpage.   

You Can Opt-Out of Receiving Our Marketing Emails 

When you sign up for our newsletter, you will be asked to provide us with an accurate e-mail address through which we may contact you. Such registration constitutes your express acknowledgment that we may use your e-mail address to communicate with you about product offerings (unless affirmative consent is otherwise required by applicable law). To stop receiving our promotional emails, you may email us at privacy@parhealth.com or follow the instructions in any promotional message you get from us. Even if you opt out of getting marketing messages, we may still contact you through email in response to your questions.

Non-Discrimination. 

You have the right to not be discriminated against because you exercise any of your rights described above. However, you may not be able to participate in some of our Services depending on the rights you exercise.  

Exercising Your Rights.  

Please note that many of the above rights are subject to exceptions and limitations, and our responses will vary based on the circumstances of the request and on your location. If you choose to assert any of these rights under applicable law, we will respond in accordance with and within the time-period prescribed by such law. 

If you are located in the State of California in the United States, a person authorized to act on your behalf may make a verifiable request related to your Personal Information.  If you designate an authorized person to submit requests to exercise certain privacy rights on your behalf, we will require verification that you provided the authorized agent permission to make a request on your behalf.  

When you submit a request, your request must: (i) provide sufficient information that allows us to reasonably verify that you are the person about whom we collected Personal Information or an authorized representative of that person; and (ii) describe the request with sufficient detail that allows us to properly understand, evaluate, and respond to it. We will only use Personal Information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.  

To exercise your rights, you must provide us with a copy of the signed permission you have given to the authorized agent to submit the request on your behalf and verify your own identity directly with us.  If you are an authorized agent submitting a request on behalf of an individual you must attach a copy of the following information to the request: 

  1. A completed Authorized Agent Designation Form indicating that you have authorization to act on the consumer’s behalf. 

  1. If you are a business, proof that you are registered with the Secretary of State to conduct business in California. 

If we do not receive both pieces of information, the request will be denied.

You may have the right to lodge a complaint with the applicable regulatory authority if you are not satisfied with how your Personal Information is being handled.  

Transfer Of Personal Information Outside the European Economic Area (EEA) and United Kingdom (UK) 

Due to the global nature of our business, the Personal Information that we collect from you may be transferred to, and stored at, a destination outside the jurisdiction where you are located for the purposes described above. It may also be processed by personnel operating outside the EEA/UK who work for us or for one of our suppliers who act on our behalf. Those countries may not provide an adequate level of protection in relation to processing your Personal Information. We will ensure appropriate safeguards are in place to protect the privacy and integrity of Personal Information transferred outside of the EEA/UK (e.g., by making use of standard contractual clauses). Other Important Information 

The following additional information relates to our privacy practices: 

  • Minors. Our Sites are not for individuals under age 18. Those individuals should not access our Sites or provide Personal Information to us. 

  • Third-Party Applications/Websites.  We have no control over the privacy practices of websites or applications that we do not own. Please reference their applicable privacy policies.  

  • Changes to This Policy.  We may change our Policy and practices over time.  To the extent that our Policy changes in a material way, the version of the Policy that was in place at the time that you submitted Personal Information to us will generally govern that information.  Our Policy includes an “effective date” and a “last updated” date. The “effective date” refers to the date that the current version took effect. The “last updated” date refers to the date that the current version was last substantively modified.
